Purchase of Sheet Music

The purchase of sheet music gives the right to use each single copy purchased. It does not give the right to photocopy additional copies, nor to perform the work in a live public performance, nor to record the work, nor to broadcast a recording or live performance. The cost of the sheet music might be expected to cover approximately half of the total licensing expenses required to put on a public performance.

Mechanical License: Recordings

This category covers the mechanical reproduction of a recording in multiple copies. All recordings must be licensed, even non-commercial recordings. They may be licensed from the Harry Fox Agency, or directly from the copyright owner by payment of fees according to the schedules below. The Harry Fox Agency ( www.harryfox.com ) has made it easy to register and pay for mechanical licenses online. If you do so PLEASE send us an email or letter, too, because their record keeping is not always as good as their billing! You may also combine licensing: partly with HFA, partly direct with the copyright holder. If you wish to license directly, read on.

For direct mechanical licensing with us, there is no minimum pressing, no minimum duration. You simply multiply the number of minutes or fractions of a minute on your recording times the number of copies, times the relevant annual rate in the schedules. Pricing and terms are somewhat more favorable to you when licensing directly, because we get paid far sooner and more reliably. For example, for a pressing of 400 copies of a 3' 10" work at the 2012-2013 rate: 4 (minutes) x 400 (copies) x 0.038 (per copy-minute) = $60.80

Public Performance Rights

To perform a musical work in public (live or broadcast), you must have a license. This category covers live performance situations and broadcasts of recordings, but does not provide the right to make a recording. Public performance rights may be licensed directly from the copyright owner or from one of the Performing Rights organizations (BMI or ASCAP). A composer is associated with one or the other: having a BMI license does not give any rights for the performance of music by ASCAP composers; having an ASCAP license does not give any rights for the performance of music by BMI composers. All music published by the Hartenshield Group, Inc, is licensed by BMI.

Usually the BMI license is less expensive on an on-going basis, but if you need the right to perform just one work direct payment might be far easier and does not involve an annual contract. Direct payment of fees for Public Performance rights should be made according to the schedules below.

When you make a payment for public performance rights, you will receive written acknowledgement of your right to the performance or broadcast. Please identify the work, date of performance, and venue for public performances. For broadcasts, contact us for more details. The rights payment schedules in this document are appropriate for use if you choose to license a performance directly from the copyright holder. It is perfectly acceptable for you to license public performances, including broadcasts, from BMI if you so choose. If you are performing other BMI music on the same concert or even on the same season, the BMI license is likely to be a less expensive option.

Grand Rights

This category covers production of music with associated dramatic action, dancing or staging. It must be licensed directly from the copyright owner. For grand rights, please write or email with your details.

No minimum pressing required. No minimum duration. You simply multiply the number of minutes or fractions on your recording x number of copies x $rate per minute per copy.

If you are licensing 2000 or more copies, you receive a 10% discount on the total.

If you are a church, school, or college you receive a 10% discount on the total.
